Changes to Housing Law in Scotland

We want to let you know about some changes to Scottish housing law that came into effect on 1 August 2026.

Most tenants will not need to do anything, but we believe it’s important to keep you informed about changes that may affect your tenancy now or in the future.

The updates are designed to provide greater protection and support for people experiencing domestic abuse, simplify some tenancy processes, and modernise how certain information can be shared.

Support for People Experiencing Domestic Abuse 

From 1 August 2026, new laws will help social landlords support people experiencing domestic abuse. 

In certain situations, it may be possible for someone who has experienced domestic abuse to stay in their home while the person responsible for the abuse loses their tenancy rights. This can help people remain close to their family, friends, schools, work and support networks rather than having to move away. 

Any decision of this kind can only be made through the courts, and each case will be considered carefully, sensitively and confidentially. 

Domestic abuse can take many forms, including physical, emotional, psychological, controlling or threatening behaviour.

Changes to Taking Over a Tenancy When Someone Dies (succession) 

From 1 August 2026, there will be a change to the rules about who may be able to take over a tenancy if the tenant dies. 

Currently, a person usually needs to have lived in the home as their main residence for at least 12 months before the tenant’s death. From August 2026, this qualifying period will reduce to 6 months

Other rules will still apply, and not everyone living in a property will automatically have the right to take over the tenancy. 

Rent Increase Notices 

There will also be changes to how rent increase notices can be sent. 

From August 2026, we may be able to send rent increase notices by email in some circumstances. If your rent is due to increase, we will always provide the required notice and explain any changes clearly, including what the new rent will be and who to contact if you have questions. 

Updated Tenancy Agreements 

The Scottish Government has updated its standard tenancy agreements to reflect these legal changes and other new requirements. 

If your tenancy started before these updates, you will not normally receive a new agreement automatically. However, some of the legal changes may still apply to you. If we ever need to provide you with updated information or a new agreement, we will contact you directly. 

What This Means for You 

For most customers, there is nothing you need to do. 

These changes are intended to: 

  • Provide greater protection and support for people affected by domestic abuse. 
  • Make it easier for some family members or household members to take over a tenancy after a bereavement. 
  • Modernise how important information, such as rent increase notices, can be shared. 
  • Ensure housing services continue to meet current legal requirements.
